Legal & Legislative Update
Hold on to your hats – the Texas Legislature is in high gear and it is a record year for bill fillings. As of this date there are over 70 bills introduced and many of them will greatly change the way associations operate. Presently being considered is legislation and a constitutional amendment to prohibit foreclosure on any owner who resides in a residence as a homestead. Also the right to non-judicially foreclose is being challenged. Imagine having to operate the association like a government entity – with open meetings and open records --- the costs of compliance and regulations are quite extensive. These bills are just the tip of the iceberg.
Additionally, we will discuss the major cases decided by the courts over the last year. These cases include Assessment collection and foreclosures, Architectural Control, Injunction, Books & Records, Business Use of residential property, Fair Housing and Debt collection issues.

Speaker: Marc D. Markel
Marc D. Markel is a shareholder of the Texas law firm of Roberts Markel P.C. with offices in Houston, San Antonio, Sugar Land, Dallas and Beaumont. He attended South Texas College of Law and was licensed to practice law in 1979. He is Board Certified in Residential and Commercial Real Estate Law by the Texas Board of Legal Specialization and is a Member of the College of the State Bar of Texas. He is licensed to practice in all courts in the State of Texas, the U.S. Supreme Court, the U.S. District Court for the Southern, Northern, Western and Eastern Districts of Texas, and the U.S. Fifth and Eleventh Circuit Courts. Marc is also a certified mediator and acts upon request as an arbiter.
Marc is a member of the Texas College of Real Estate Attorneys; a charter member of the College of Community Association Lawyers; He is a member of the Houston Bar Association; Fort Bend Bar Association; Montgomery County Bar Association; Bexar County Bar Association; Dallas County Bar Association; American Bar Association. He has been elected to the Texas Super Lawyers List for 2005 through 2008 for Real Estate.
His CAI experience include: Greater Houston Chapter, Past President and Past Director, National – Member Board of Trustees 2003 – 2005, Member Business Partners Council 2004-2005, Past President, and Former Director of the Foundation for Community Association Research, immediate past Chairman of the Texas Legislative Action Committee.
